These Terms and Conditions shall apply to all sales and services through Fix Molin AB, the owner of the Locamundo.com website, and will exclude the application of any deviating general or specific conditions or terms of buyer. No waiver or modification of these Conditions of sale shall be binding upon Fix Molin AB unless approved in writing by an authorised representative of Fix Molin AB. Disputes regarding this service shall be settled by a Swedish court and shall in the first instance be referred to the district court (Tingsrätten) of Stockholm.
Price and Payment
Fix Molin sells every product and service on the Locamundo.com website, and the price is shown excluding Swedish value-added tax (VAT). Fix Molin AB accepts payments by VISA, Mastercard, American Express and PayPal. In some cases and by exclusive agreement, Fix Molin AB may receive payment directly from your bank or payment per invoice.
When purchasing monthly accounts, Locamundo will apply automatic debit as a payment method.
When the monthly account with Locamundo expires, Locamundo charges the credit card or PayPal account used when the monthly account was last purchased/extended.
When purchasing a Locamundo annual account, Locamundo will apply automatic debit as the payment method.
When the annual account with Locamundo expires, Locamundo charges the credit card or PayPal account used when the monthly account was last purchased/extended.
A notification will be sent well before you are charged (1 month) so that you can take action, such as changing your payment or canceling your account.
Service delivery
Delivery of purchased services shall be made without delay. However, Fix Molin can invoke delays which may be due to technical factors outside of Fix Molin’s control. Examples of this may be problems linked to the supplier of Internet services or the electricity supplier. Most services that are sold by Fix Molin AB are automated and delivered without human intervention. In cases that require personal supervision, Fix Molin guarantees support and services 8 am - 5 pm + 1 GMT on weekdays. Swedish holidays are closed.
Client, search accounts
Customer (CLIENT SEARCH ) accounts are sold without the possibility of reimbursement. Exceptions are so-called double purchases. This means that the customer has accidentally and unintentionally paid twice or even more times. Such purchases will be refunded within 72 hours upon request from the customer within 90 days of the purchase date. We might charge 3% of the purchase price in processing fees, which will be deducted from the refund.
Scout Accounts & other uploading accounts
Monthly and yearly accounts (BASIC, BASIC+, PRO and PRO+) are sold without the possibility of reimbursement. Exceptions are so-called double purchases. This means the customer has accidentally and unintentionally paid twice or even more times. Such purchases will be refunded within 72 hours upon request from the customer within 90 days of the purchase date. We might charge 3% of the purchase price as processing fees, which will be deducted from the refund. In case of non-payment of account fees, the account will automatically be suspended without delay. The account holder will be reminded three times by email sent to the email address used when registering for the account renewal. Afterward, Fix Molin AB will delete the account without further reminder.
Termination Policy
An account is terminated from the date it is canceled and if the account owner so desires. Otherwise, the account is terminated when the account is no longer paid for or when the term of the account has expired. When a customer (CLIENT SEARCH) or a scout (BASIC, BASIC+, PRO or PRO+) terminates an account, all materials that have been stored in the account will be deleted by Fix Molin AB (Locamundo). All the information in these accounts is considered to be the account holder’s private property until its deletion. Fix Molin has the right to delete data without any notification when an account is not paid for any longer or if its owner cancels the account. Upon termination of the account, no money will be refunded for the remaining account time.
User rules
The user of our service, Locamundo, agrees to abide by the following rules. The account holder is responsible for all the images and information that are uploaded to the account. It is strictly prohibited to store photographs that you do not own the rights to or images that contain people who have not given their consent to be on the Locamundo server. It is forbidden to display images online that include texts, logos, or watermarks that in any way, reveal the identity of the owner to the image or location. The account holder agrees not to upload pictures of material that may be not considered as film locations. It is forbidden to upload pictures that may be offensive in the legal sense (Swedish law).
Furthermore, it is forbidden to upload images showing ongoing acts of crime or which are criminal in nature. Fix Molin AB may without notice to the account holder spot-check the database to search for pictures of a criminal nature. Fix Molin AB reserves the right, in case of a suspected crime, to cooperate with the police without notifying account holders. Fix Molin reserves the right to close an account on suspicion of violation of these rules, pending an investigation. Fix Molin will close the account permanently if it is found that an account holder used his account for criminal acts. No refund of account will occur in such a case.
Guarantees and Services
Fix Molin AB guarantees that Locamundo should be fully operational 365 days a year, 24 hours a day. Exceptions are planned interruptions of service that shall be notified to the account holders at least seven days before the said service interruption. The warranty is valid for the following conditions” If the downtime is more than two hours, all money back on one-day accounts. If the downtime is more than 6 hours, all money back also on two-day accounts. If the downtime is more than 12 hours, in addition to the situations mentioned above, Fix Molin AB will add 25% of the remaining time on all other account types. This time will be added to all the existing paid accounts. All reported problems will be taken care of by our support team. Working hours are 8 am - 5 pm weekdays. Critical issues will be addressed 24/7.
Privacy Policy
When ordering a product/service, you will be asked to fill in your personal information. Upon purchase, you agree that this information will be stored per Fix Molin's privacy policy to fulfill our agreement to you as our customer. We collect and handle personal data only to deliver our service. We do not collect more personal data than necessary to provide the service. Collected personal data will not be sold or shared with other players than required to deliver this service. All personal data is managed under GDPR and is only saved while the customer relationship needs it. All storage is carried out in a safe environment following the GDPR. All collected data is available for change, forwarding, and deleting on request.
Fix Molin AB takes no responsibility for the personal data stored by users of SCOUT and SEARCH accounts. These users' responsibility is to ensure that applicable GDPR rules or rules that may be applicable outside of Sweden are followed according to applicable laws.
Responsibility
By entering into this Agreement, you agree that Locamundo accepts no financial or legal responsibility for any damage that could affect you or your company as the user of the product Locamundo. Some examples of this may be loss of data or other information, and incorrect information leading to wrong decisions by the customer and which subsequently led to an economic or legal injury. Moreover, Locamundo does not accept responsibility for services within Locamundo supplied by third parties. Examples of such companies may be Google Inc., Dropbox, Stripe inc, Mild Media AB, etc.
Force Majeure
Fix Molin is not liable for any performance issue due to circumstances beyond our control, which directly or indirectly prevents, obstructs or renders production, delivery or freight impossible until such obstacle has been removed (force majeure). Such circumstances shall be deemed to include difficulties to procure raw materials as well as other difficulties and disturbances, including but not limited to wars, riots, labor conflicts, pandemics, fires, floods, storms, accidents, fuel or power shortages, transportation shortages, obstacles or interruptions regarding transportation at sea and breakdowns or interruptions of any kind as regards to our equipment or facilities, which are deemed necessary for the performance of our agreements' obligations.
